I’m definitely in agreement with you over the whole disability thing. I think that having her be disabled and unable to ever fly would add a lot more depth and potential to her character. According to the bottom paragraph of the “Flying and scooting” section of the Wikia, it seems like Lauren Faust may have originally planned for Scootaloo to be handicapped.

That’s nice to hear. Being cripple is enough. Orphan enters Mary Sue territory - or more specifically, not that she’d be an OP character, but have a needlessly tragic backstory on top of her possible* disability that wouldn’t really add anything to her character. Being a Pegasus that admires RD like crazy but can’t fly is bad enough.
 
And it’s not like we don’t have enough orphan protagonists already. Batman, Superman, Spiderman, Harry Potter, Luke Skywalker…
 
Seems like it’s a bit (a lot) overused.
 
*“I don’t know if you’ll ever fly…” I hope she doesn’t fly just because there’s enough real people with things like that that I think “you can have a happy ending even if you never fly” would be a great point that would be thrown away by some late blooming.

Lauren Faust has recently said that Scootaloo was never intended to be an orphan in a tweet. The current Supervising Director, Jim Miller, responded by saying that he tries to stay true to the characters as she originally saw them and views things the way they came from Lauren’s head.

The fact that she’s cripple and ambiguously orphan (even though she has her own room as we saw, people will still think she’s orphan and there’s some small room for that possibility…) makes her like a Tiny Tim that people love to see suffer or something. Kind of like the universe’s punching bag.

I realize a lot of the Applebuse tags were really Jackabuse in this screenshot, but I just did a search and there’s 122 Applebuse but only 76 Jackabuse
 
I will admit, I do find seeing fillies get beat up kind of funny
