Actually, some have done similar things in the past. Dunno if they do that on the Pony comic tho’.
Like the (dare I bring it up) Cuteosphere OC cameo being inserted in the comic, was writer Ted Anderson’s fault, as he had artist Ben Bates draw it for him. So it’s not always the artist’s fault for these kinda things, but who knows.
Pretty sure writers don’t normally pick out specific reference images like this
The writer and/or editor tells the comic artist what to draw. Whether in person, or in a script.
What? You think artists always just draw whatever the hell they want with no guidance? You guys seriously need to learn how comic books are made.

Yeah, I don’t think he, the editor, or writer, or whoever saw said pic meant to steal. Normally, they’re very strict about not using fan-made material, so I assume they mistook it for official art, much like Sega/Sumo did.

IIRC something like this happened in issue 2 of the Micro series, where Tony Fleecs used an image of Rainbow Dash’s bedroom as a reference without realizing it was fan art because it was so well done it looked like a real show location.
Kinda reminds me of when he used clip art for a cutie mark.

But again, Hasbro’s also supposed to be checking these too.

I remember Sega & Sumo Digital awhile back mistook a fanart piece for an official art, and used it in a game. (They removed it, and apologized to the fanartist with a neat giftbasket. Ironically, the artist wasn’t upset, and found the situation flattering.) Could be the people who work on the comic could’ve done the same mistake.
I wouldn’t fault Fosgitt alone though, as the comic editor, and/or writer tell the artist what to draw, and could be equally, or more-so responsible.
