However, if the new employer’s hiring decision (or the old employer’s firing decision) is found to violate anti-discrimination law or other relevant laws, then yes there will be legal problems. That’s probably why company policy so strictly limits what information is handed out.
All the same, the old employer may reveal pretty much any information that was lawful for them to know without any legal consequence as long as they aren’t accused of unlawfully firing. If they choose to say you were fired for looking at dragon hoochie porn at work, then there’s not much you can do about that.
I suppose you could try to sue for damages if it permanently affects your career opportunities, but how likely are you to win that one?
actually, you are not legally required to reveal to prospective employers why you were fired from a previous job. and while it’s not strictly illegal, it’s very legally risky for both the employer to investigate into that sort of thing and for the old employer to reveal that kind of information. Risky enough that most employers, when called by a new employer to verify employment, will only verify the dates they were employed and nothing else.
Yes, but getting fired for that sort of thing also makes it harder to get hired other places.
