Gratuitous? That would imply it’s uncalled for. If Derpy laid down her spear and surrendered to Tirek, and then he still did that to her, maybe you would have an argument. But she was defending against him and ready to fight. There’s nothing gratuitous about that scenario.
It’s gratuitous cruelty, therefore abuse.

depends on the view, here derpy is a guard and is attacked by Tirek, the main scene is not about abusing, its like fighting and taunting.

I don’t think every dark scene is abuse if bad thing happen, and I asked the tagging because this image is pretty mild, not nightmare including. Also there was grotesque tag, so normally you would not see it, only if you accept the filter.
