I’ve seen newly-manufactured NES consoles out there. I think Nintendo’s patent on the NES hardware might have run out or something.
 
If all you need is the console and controllers, then you’re in luck. The games are trickier to get a hold of, though…

There’s no need to write a 3DS emulator specifically for the 3DS, because NESDS will run on it just fine via the proper flashcart, since the 3DS can run DS software.
 
Flashcarts themselves are the main barrier. The online nature of the 3DS means Nintendo can stay one step ahead (or at least only a step or two behind) the chinese pirate industry by blocking out new flashcarts via frequent firmware updates.

You realize this is an NES cartridge, yes? You do realize there are multiple NES games on the 3DS virtual console? Some of them being 3D enhanced versions?
 
And I believe that a large number of retro gamers, let’s players, and youtubers would disagree with your statement that the NES is a “dead and gone” system.
 
There are multiple websites out there in fact that product reproduction NES games, of romhacks, english translations of famicom games, and homebrews, so this could very easily be a thing if someone put in the effort.

This is just brilliant; I love anachronistic game/platform combos, it’s like Video Dada. I saw someone at a con once who’d used a VHS shell to house an external hard drive full of anime, so he could open the access door and plug in the connectors to watch whatever on anyone’s laptop.
 
Someone needs to make old 8bit and 16bit shells like this with connectors so they can plug into modern cartridge consoles.

You can actually buy retro game playing systems at various stores. They can play a variety of older generation games (NES, SNES, Genesis, etc), and some of them are even designed to be portable systems for easy travel.

Except, not many people have a (functional) NES today. Nintendo would rather continue to release NES games via Virtual Console like they have been doing.
