Did you read past the first sentence, because my post actually backed up that claim with evidence. If they were legally obligated to take down content which infringed their trademarks then derpiboo.ru would have been shut down long ago.

The forced copyright defense is pretty much bullshit. It takes a lot more than a single piece of fan art/game to make a trademark count as “abandoned”, otherwise Hasbro would be shutting every single fan site down.

I still don’t get this forced copyright defense. When a company defend its copyright, it have to do it with its own legal services right? and since every C&D can be opposed by a fair use counter argument it should be up to the company itself to decided if a legal procedure is justified or not based on their own estimation of chances to win a trial about it, just like the state prosecutor who can refuse a case that he don’t see as good enough to be presented to the judge. Which office decide what deserve or not a legal action and if company defended its copyright correctly or not?

Trademark and copyright are very different IP systems. Hasbro’s C&D of the 3D sculptures and the Magic-like CCG make sense now that they have licensees doing the same. Shutting down FIM is more simply because that’s not an image they can have associated with their characters, under trademark law.
 
What Hasbro hasn’t done - save through YouTube’s contentID system - is issue copyright lawsuits (though my mind is blurry on what happened to that one site that was compiling all the episodes). They certainly haven’t purposely gone after any fan-created vids directly (something like FIW was a ContentID problem, which is more YouTube’s fault for being overly sensitive).

Hasbro lost rights to like 95% of G1 for a reason similar to that, didn’t they? I know that they don’t own anything from G1 any more except for some characters that were in all gens (Pretty much just AJ and Spike)

Also funny: They’ve trademarked Derpy’s name. They know that they can sell stuff with her name clearly on it five or ten years down the line when everything calms down, so they jumped on it so no one else could.
