Spike has always been kind of a complicated case though. I'm pretty sure its still impossible to truly prove he's underage.
 
We know he was born when the Mane6 were seemingly around 6, so if they are at least 24 by now (which is possible), then he'd no longer be underage no matter how hise BODY still looks due to dragon's bodies growing at a different speed than ponies'.
