The pregnency and regret portions of the comic you are referring to are not present in this image, and there is zero evidence in this image that any implied sex was non-consensual - in fact Derpy is happy immediately following the implied act.

Iunno man, she looks to be gettin’ a little drunk there, drunk sex is nonconsensual on some level due to inhibited judgement, i’d say that drunk sex would imply lack of consent, but some people will spread their legs regardless of alcohol consumption.
 
I don’t think it’s ever called rape in the story, just that she really regrets it when she gets home, but by then it’s already happened. Though it becomes apparent later on that she’s preggers, and obviously did not consent to that part, but w/e, semantics.

Well, that’s how the law works in the US IIRC. Although, I don’t know that the legal definition would apply to Derpi tagging, since, as Bexar Bandito pointed out, that would make all foalcon technically statutory (which I doubt the mods would go for).

i was looking for any indication that he roofied her and i didn’t see any. the rest of the comic didn’t even hint at it. as for the issue of consent, that’s a confusing one here because she had no qualms about getting drunk and getting romantic before or immediately after her encounter. she only comes to regret it after firefly tells her that pokey already tried to have his way with rainbow dash and was just using derpy. she is indeed a teenager in the context of the comic but if we were to tag this as “rape” or “grimdark” because of that we’d have to apply those same standards to the hundreds of foalcon pictures on derpibooru with a noticeable age disparity. i know the picture is depressing in the context of the comic, but i seriously don’t think this qualifies for the rape or grimdark tags, or even semi-grimdark for that matter. i’m not the one to decide that, though, since there are people who are better equipped than i to make judgments like this. with that being said, bear with me.

They’re horses, bruh. I doubt Derpy is 16. Not only that, but saying “oh she was drunk so she can’t consent” is retarded if someone chooses to get intoxicated. We don’t let drunk drivers off the hook. “Oh, but he offered her booze!” Unless he forced it down her throat, no. Aside from that, everything else is conjecture.

This is considered rape and date rape for two reasons; the mentioned fact that she is drunk and and therefore can’t give proper consent, notice that his glass looks full. And two at most she is 16 here and assuming human ages and that 18 is the age of consent since Pierce is above 18 this would count as statutory rape.

for anyone confused by the tags, this is an excerpt from >>451093. as it turns out, pokey pierce is a womanizer who was just using derpy. i think it’s heavily implied in the other comics that she got pregnant from the encounter, hence the tag. still not entirely sure why it’s tagged date rape though, unless you consider drunken sex to be non-consenting sex.
 
without context, though, it’s super adorable so i’m guessing that’s why it was cropped like this.
