As it has been reported twice now: the artist at the source has placed their image under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 License, which means that they have chosen to allow redistribution with suitable credit. The license is quite clear in its statement that redistribution of the work cannot then be restricted as long as the license is applied, regardless of any statements the artist might make to the contrary. If the artist wants to prevent properly credited redistribution, they should not place their work under a license that explicitly allows it.
