I could honestly imagine courts just de facto treating anything sapient as "human". Would cause issues for differing psychology (should an alien sapient species even fall under human law if their psychology is different enough?), but if it's similar enough I imagine judges would be somewhat reasonable about it.


 
As unreasonable as courts can be, they generally try to be reasonable. And there's always "the law you won't be told" (Jury anollement).
 
Though given Ponies, Griffons, Yaks, Zebras, Minotaurs - Equestria probably just does this automatically.
