Whether or not that specific one is or will be successful in escaping, the clear implication is that Pinkie was at least attempting to eat him, and judging by her cute little pudge of a belly, may have already been successful in eating a few others.
 
But even if none of that applies in this specific picture, that doesn’t answer the larger question, as to whether or not it would be vore if Pinkie, or somepony in this or a similar situation, were to eat living, or at least magically animated, food.
 
I was really only asking for purposes of clarifying accepted tagging standards.

Judging from the expression on the face of the gingerbread man in Pinkie’s mouth, I’d say they were tying her down and forcing her to eat them…
