While Celestia or Twilight rule Equestria, I don’t think either of them would have that as part of their judicial system. At worst, a criminal would be sent to Tartarus, but they’d still be alive.

She probably got the verdict not guilty by reason of insanity. That means she had no idea that what she was doing was wrong. I guess in her head she was ‘just’ making cupcakes for her friends
