I think its an airsoft, because it has a third pin for an ayto sear, but I highly doubt that its a NFA registered machine gun. The BATF doesn`t let just anyone own an automatic weapon, so I think it is a high end airsoft pictured with a real loaded magazine

Some Airsoft Mags have dummy bullets in them, especially if they are for weapons that use clear mags like G36s. I think it isnt a real M4 due to the fire-select has 3 settings.
