I agree, he isn’t a pet, but this drawing came out around season 1. And if you remember, season 1 was where all the ponies tended to be their worst to spike, by ordering him around, and hardly paying attention to him, as if he was some insignificant pet. But by the time the owl came along, and season 2 was a bit kinder to spike and his interactions with the ponies. Also in the Secret of My Excess, twilight takes spike to a pony doctor first, and only takes him to a vet after it’s been suggested. If she saw him as a pet, she would’ve taken him there first. And the final nail in the coffin for the “spike being a pet” theory, was when they gave spike a pet of his own, Peewee.
 
So this artist didn’t know about the development that would prove otherwise at the time.
