Except tat you can? of course, given the appropriate circumstances and elements and as long there’s enough “harmony” around. After all, Celestia and Luna did it once.
This guy has taken his own head off as it transformed into a balloon and it meant nothing. He rolled his eyes and they fell in golf holes which turned into his eye sockets and he phased out of the ground. For a smoother screen transition his head was once on both sides of his body.
You can’t kill this guy. You can’t even imprison him.

He’s so powerful he could’ve easily killed ponies, and he definitely had everyone’s lives under control in a “won’t let them accidentally die” sort of way, so I don’t think anyone’s life was really in danger.
I mean, robbed of all meaning and coherence, maybe, but not in danger.
Technically you’re only a criminal if a second party presses charges; if Celestia didn’t press charges then she didn’t need to pardon Fluttershy since that meant she was never formally charged.
Celestia has no real power, it’s a conspiracy.

To be fair there, the mane six didn’t do anything bad until AFTER they’d saved the world and bonded to artifacts of world destiny importance.
Once they’d become element bearers and stopped discord and nightmare moon, you’d probably want to give them more than a little leniency, in a pragmatic sense.
I mean, if Superman went and did a petty crime (like say, destroying that trucker’s truck in man of steel) 99.9% of the people on the planet would be like “ignore it” due to his importance to the world.

I would say he’s more classified as an anarchist.
The issue with classifying him as a terrorist though is that he’s not actually trying to DO anything, as most terrorist attacks have a purpose.
He’d more just be engaging in wanton vandalism and endangerment of lives.
